This statement was made as the court was set to decide whether the label could remain in place while the case was ongoing.

The Stakes of an Unprecedented Designation

On March 3, Defense Secretary Peter Hegseth officially informed Anthropic of its classification as a supply chain risk. This was the first time such a designation had been applied to an American company. Prior to this announcement, Dario Amodei had publicly expressed his opposition to Hegseth's demands, which sought unlimited access for the Pentagon to Anthropic's AI models for "any lawful purpose." Amodei feared that this could lead to abuses, particularly in the surveillance of American citizens or the use of AI in autonomous weapons before they were sufficiently safe.

A "Concerning" Designation

Judge Lin, who has handled other significant tech cases, emphasized that classifying Anthropic as a supply chain risk was "concerning." This designation is typically reserved for adversaries of the U.S. government that could compromise its technological systems. According to Lin, the Department of Defense could have simply stopped using Claude, Anthropic's AI, instead of taking such a drastic measure.

Anthropic has filed lawsuits to temporarily and permanently block Hegseth's action, as well as a separate order from former President Donald Trump, which demanded that all federal agencies cease using Anthropic's technology within six months. In their legal documents, Anthropic highlighted that this designation threatened hundreds of millions of dollars in the short term due to the uncertainty it created for defense contractors also using Claude. Furthermore, Anthropic's reputation and its fundamental freedoms under the First Amendment are under attack, according to the startup's lawyers.

Silicon Valley is closely monitoring this case, as a broad interpretation of the Pentagon's restrictions could affect partners like Microsoft.
