xAI vs. Minnesota: Battle Over Grok Images

Elon Musk, rather than making changes to his chatbot Grok, has opted for legal action. His company, xAI, which is now part of SpaceX, has recently filed a lawsuit against the state of Minnesota. This decision follows the adoption of a law aimed at prohibiting the creation of nude images of individuals without their consent.

The legislation was initiated by Democratic Senator Erin Maye Quade. She was motivated by an incident where a man used photos available on social media to generate sexual images and videos of 80 women in his circle without their consent. This law, adopted in May, bans "nudification" technologies that allow for the creation of fake nude images of individuals based on their photos. It imposes a fine of $500,000 per image created in violation of this law, even if they are not shared or distributed. Victims can also file individual lawsuits against the responsible companies. The law is set to take effect on Saturday, August 1.

xAI Invokes the First Amendment

Elon Musk and his company xAI are not satisfied with this legislation. On July 27, xAI filed a complaint in federal court. The company's lawyers argue that the law exceeds its original intent. While they do not contest the need to combat the creation of non-consensual images, they believe that the definition of "intimate parts" is too broad. According to them, the law could prohibit images of bare male torsos or people in swimsuits, common situations in public spaces. To support their position, xAI invokes the First Amendment of the U.S. Constitution, which protects freedom of expression.

Furthermore, xAI points out that the $500,000 fine per image could lead to astronomical sums. If 100,000 images were generated by its users, the total fine could reach $50 billion, an amount the company deems disproportionate. xAI claims to have implemented measures to block such content and ban offending users.

Scandals Pile Up

The image generation feature of xAI, Grok Imagine, is at the center of several recent scandals. In the United States, a photographer from Arkansas has been accused of using this tool to create sexualized images of his underage clients. xAI asserts that it has taken steps to combat these abuses, with over 70,000 reports of suspicious content leading to at least 244 arrests.

In Europe, the situation is also concerning. The European Commission launched a formal investigation against X.com earlier this year under the Digital Services Act (DSA). This investigation aims to determine whether the company has properly assessed the risks associated with Grok, under the threat of a fine of up to 6% of its global revenue. Despite these pressures, Elon Musk's group does not appear ready to withdraw the feature to prevent such abuses.
