xAI and Its Unregulated Gas Turbines in Mississippi
Elon Musk, through his company xAI, is currently operating 46 natural gas turbines at a data center located in Mississippi. These installations evade state regulation due to a legislative loophole that classifies them as "mobile."
A Exploited Legislative Loophole
The turbines are mounted on trailers, allowing them to be classified as "mobile" by the state of Mississippi. This classification enables them to bypass air pollution regulations for a period of one year. This situation has raised concerns, particularly from the NAACP, which has filed a lawsuit to defend local residents.
Legal Actions
The NAACP has filed a complaint, asserting that the uncontrolled emissions from these turbines are degrading air quality in an area already affected by pollution. The Southern Environmental Law Center has filed the lawsuit on behalf of the NAACP, emphasizing that these turbines, although mobile, should be subject to federal air pollution laws, as they can be considered stationary. This week, the NAACP requested an injunction against xAI from the court.
Permits and Installations
xAI has obtained permits for 15 of its turbines. A statement from the Greater Memphis Chamber of Commerce mentioned that about half of the 35 turbines operational in May 2025 would remain in place. Despite this, xAI has continued to install additional turbines, currently reaching a total of 46 turbines in operation, according to a local report.
