In response, the Pentagon argued that a private company should not impose its conditions on the military use of technologies, asserting that they would be used in a "legal" manner.

The government also claimed that Anthropic's public criticisms of the DOD justified the ban. However, District Judge Rita Lin found this reasoning "truly concerning," emphasizing that it could set a dangerous precedent for retaliation against federal contractors who express disagreement with the administration.

Furthermore, the DOD expressed concerns that Anthropic could disable or alter its AI models during military operations. However, experts deemed these concerns unfounded, and Judge Lin agreed that there was no evidence that Anthropic could modify a delivered model or activate a "kill switch."

This hearing is part of one of two lawsuits that Anthropic filed against the DOD in March, challenging both the ban and the risk designation. The second case is currently under review in Washington.

Judge Lin, who temporarily suspended the ban in March, must now decide whether this order should be made permanent.
