ChatGPT and Grok Overwhelm British Employment Tribunals
Applications for interim measures in British employment tribunals have skyrocketed, increasing a hundredfold. Workers are using ChatGPT or Grok to draft legal claims for free, instead of paying lawyers. A memo from tribunal presidents Barry Clarke and Susan Walker paints a concerning picture. Claims have risen by 39% in the year ending March 2026, and the backlog of pending cases has surged by 55% to reach 64,000 unresolved cases. Many AI-generated submissions consist of hundreds of pages, filled with fabricated laws and unrealistic demands.
The situation could worsen further. The new Workers' Rights Act from the Labour Party adds around 25 new grounds for claims and removes compensation caps. The Economist describes this as a "tragedy of the commons, AI-style." Workers with legitimate grievances are waiting longer for justice. Employers must spend more to respond, whether the claims are legitimate or fabricated.
The United States is facing a similar crisis. A federal judge has labeled AI-generated lawsuits as an "existential threat to federal courts." A study from Pakistan shows that it can work the other way around: judges using AI tools and receiving training handled more cases, more quickly.
