The European Union places ChatGPT, Roblox, and Reddit under the enhanced regime of the DSA. The three services must analyze and mitigate risks, particularly for minors, within four months, amid ongoing checks and fines already imposed on other platforms.
Ongoing Investigations and Financial Risk of Up to 6% of Revenue
Several procedures illustrate the vigor of Brussels' oversight. The European Commission accuses TikTok of failing to meet its obligations regarding the protection of minors, and an investigation is underway under the DSA, pending final results. In March, the Commission also launched an investigation into Snapchat, suspected of exposing minors to grooming attempts and transmitting information about the marketing of illegal products, such as drugs or age-restricted items. On the sanctions front, Temu was recently fined €200 million for violations related to the dangers posed by illegal products. The DSA allows for penalties of up to 6% of global annual revenue, depending on the nature, severity, frequency, and duration of the violation. Should they fail to comply, ChatGPT, Roblox, or Reddit could also face investigations.
Four Months to Map and Mitigate Risks
ChatGPT, Roblox, and Reddit have four months to comply with the DSA requirements. The obligations focus on assessing and mitigating systemic risks associated with their services and algorithmic systems. They specifically address the dissemination of illegal content, negative effects on minors, impacts on users' physical and mental well-being, and public safety. These services will be subject to enhanced oversight and must implement specific measures for minors.
Why These Three Services Fall Under the Enhanced DSA
The European Commission has classified ChatGPT as a very large online search engine, while Roblox and Reddit have been identified as large online platforms. These classifications stem from the Digital Services Act, which pertains to services with more than 45 million monthly users. Once designated, a service must comply with additional obligations aimed at better protecting consumers.
