A Deployment Considered Contrary to Google's Commitments Made in 2022

The Alliance of General Information Press (Apig) officially referred the matter to the Competition Authority on Tuesday, August 11, 2026. This action follows the introduction of AI Overviews and AI Mode by Google in France. The Apig calls on the regulator to ensure compliance with the commitments Google made in July 2022. These commitments included good faith negotiations, transparency, and non-discrimination, which were to be upheld until 2027, according to the Apig's statement.

The Apig emphasizes that the launch of these features occurred without prior consultation. Publishers faced a difficult choice: accept a modification of their licensing agreement or withdraw their content, risking a loss of visibility in search results.

Publishers do not oppose innovation but insist on a fair sharing of the generated value and compensation for the use of their content, in accordance with the law. In the absence of fair and transparent negotiations, the Apig decided to approach the relevant authorities to enforce these obligations, stated Marc Feuillée, president of the Apig, in a statement.

A New Phase in the Standoff Over Neighboring Rights

The law of July 24, 2019, made France the first country in the European Union to incorporate the directive on neighboring rights, which requires prior authorization and compensation for the use of press content. This legislative framework has already led to two sanctions against Google by the Competition Authority:

  • A decision for unfair practices in April 2020.
  • A fine of 500 million euros in July 2021 for failing to comply with the negotiation obligation.

The current commitments invoked by the Apig were made following this second sanction. On July 8, 2026, after a referral made by the Apig in September 2025, the Competition Authority also issued four interim injunctions against Meta. Benoît Cœuré, president of the Competition Authority, emphasized that the protected content used by AI Overviews must be compensated under neighboring rights, as mentioned in the Apig's statement.

The Impact of AI Overviews on Publisher Traffic

Following the deployment of AI Overviews in France, several studies have shown a significant decline in publisher traffic. According to an assessment by Arcom cited by the Apig, European markets where this feature is active have recorded a traffic decrease ranging from 33% to 38%.

In the United States, where AI Overviews has been available since May 2024, Define Media Group observed a 42% drop in traffic across a panel of 64 editorial sites. These figures illustrate the considerable impact of this technology on the visibility and audience of press publishers.
