This trend is partly fueled by the increasing popularity of virtual companion apps, which offer emotional and sometimes romantic interactions. Julia Rodgers, founder and CEO of Hello Prenups, shared with Business Insider that some of her clients wish to include clauses in their prenuptial agreements that consider interactions with AIs as a form of infidelity. While she could not disclose exact clauses, she described a typical example: engaging in an intentional relationship with a chatbot or AI avatar with the aim of developing a romantic or sexual connection. This includes exchanging sexually explicit messages, role-playing, expressing romantic love or exclusivity, and maintaining an ongoing intimate relationship that any reasonable person would consider romantic or sexual.

With the rise of loneliness and the emergence of apps like Replika and EVA AI, more and more people, even those in relationships, are turning to these technologies to fulfill emotional or romantic needs. Prenuptial contract attorneys report that questions about how to incorporate these new forms of relationships into agreements are becoming increasingly common.

Legal Challenges of AI Infidelity Clauses

Elizabeth Yang, a California attorney, mentioned that her firm has received requests to include AI-related infidelity clauses in prenuptial agreements. However, she advises against this practice due to the difficulties of enforcement and the risks of future litigation. For such a clause to be functional, it must include a clear definition of the prohibited behavior, a method for proving a violation, and specific financial consequences. Thomas emphasized that these three elements are essential for the clause's viability.

For example, a clause might stipulate that an individual should not spend more than a certain amount on an AI companion or spend an excessive number of hours interacting with a chatbot. The agreement should also detail the necessary evidence to establish a violation and the financial penalties, such as a reduction in alimony or a decrease in asset division.

Prenup attorneys emphasize that drafting these contracts goes beyond their mere content. With the recent emergence of AI companions, it is crucial for couples to discuss and agree on what is acceptable in their relationship. Although most prenuptial agreements are never contested in court, their primary purpose is to prevent prolonged legal conflicts.
