Elon Musk has recently made significant changes to his lawsuit against OpenAI and Microsoft. In an unusual move, he has requested that the damages, which could exceed $150 billion, be paid not to himself, but to OpenAI's charitable foundation. This decision was reported by the Wall Street Journal. Musk's attorney, Marc Toberoff, clarified that Musk is not seeking a single dollar for his own benefit.
Accusations of Mission Betrayal
Musk accuses OpenAI of straying from its original nonprofit mission, a mission he helped fund. He claims to have been misled as a donor, with OpenAI having exploited its nonprofit status. Musk is also demanding that CEO Sam Altman and OpenAI President Greg Brockman return their shares and financial benefits to the foundation. Additionally, Musk is pushing for Sam Altman's removal from the foundation's board. The trial is scheduled for April in Oakland, California.
Context and OpenAI's Reactions
Despite the accusations, preliminary interview documents reveal that Musk had agreed to the addition of a for-profit unit in 2017. He even actively participated in discussions about this transition while maintaining OpenAI's nonprofit structure.
OpenAI has responded by labeling the lawsuit as a "harassment campaign driven by ego, jealousy, and a desire to slow down a competitor." The company has also sought an investigation from the attorneys general of Delaware and California into Musk's behavior. Currently, OpenAI is valued at $852 billion and is considering an initial public offering.
