OpenAI Considers Legal Action Against Apple

OpenAI is currently grappling with increasing frustration towards Apple regarding the integration of ChatGPT, which has not met the expected subscription and visibility goals. According to Bloomberg News, OpenAI is seriously considering suing Apple. To this end, the company has hired an external law firm to explore its legal options. Among these options, sending a formal notice of breach of contract to Apple is being considered, although a full lawsuit is not yet on the immediate agenda. This action could be delayed until the conclusion of OpenAI's ongoing lawsuit with Elon Musk.

A Strained Partnership

This dispute highlights the challenges faced by major software companies when collaborating with Apple. The iPhone, while an extremely attractive platform for growth, remains under Apple's total control. Companies looking to expand within it often have to navigate an environment where they are merely guests. OpenAI is not the first company to feel this pressure. From Google to Adobe, many partners have already faced Apple's stringent management.

ChatGPT Integration at Apple

The partnership between OpenAI and Apple, announced at the Worldwide Developers Conference in June 2024, aimed to integrate ChatGPT into Apple's operating systems. This integration allowed users to utilize ChatGPT as an option within Siri and in the iPhone's Visual Intelligence feature. Users could analyze their surroundings through their camera and send photos to ChatGPT to ask related questions. OpenAI and industry observers had high hopes for this deal, anticipating billions of dollars in new subscriptions and a prime position within Apple's mobile ecosystem.

Disappointed Expectations

However, Bloomberg reports that OpenAI is increasingly dissatisfied with the situation. The company complains that the integration is difficult to find and that the revenue generated is far below expectations. An OpenAI executive told Bloomberg: "They essentially said, 'OpenAI has to take a leap of faith and trust us.' That hasn't gone well."

Apple's Grievances

On its part, Apple has expressed concerns regarding OpenAI's privacy standards. Additionally, Apple is irritated by OpenAI's hardware initiative, an effort led by former Apple executives, including former design chief Jony Ive. This situation echoes other past tensions between Apple and its partners.

History of Tensions with Apple

Apple has a long history of strained relationships with its partners. The most famous case is that of Google Maps, which was a flagship feature of the original iPhone. Its removal in 2012, replaced by Apple Maps, was one of the biggest tech fiascos of the decade, leading to public apologies from Tim Cook. Adobe also suffered when Steve Jobs refused to support Flash on the iPhone and iPad, effectively condemning the technology. Spotify, for its part, has long accused Apple of using its control over the App Store to disadvantage competing streaming services, which led to a fine of nearly €1.8 billion from the European Commission in March 2024.

Possible Reconciliations

Despite these tensions, some rifts have been overcome in the name of business interests. Google is now Apple's AI infrastructure partner, having struck a multi-year deal in January to power the next generation of Apple Intelligence with Gemini models. Apple pays Google about $1 billion per year for this collaboration.

OpenAI Facing Other Challenges

Meanwhile, OpenAI must also manage strained relationships with other partners. Elon Musk's lawsuit against the company, accusing it of abandoning its founding nonprofit mission, is ongoing. Additionally, OpenAI is navigating tensions with Microsoft, its largest supporter and infrastructure partner, as it seeks greater independence ahead of its own IPO ambitions.
