Ba allegedly even attempted to circumvent European safety regulations during the launch of Grok Code 1, preferring to release an unsecured model rather than a poorly performing one. According to the complaint, Ba reportedly stated, "AI will kill us all anyway," illustrating his opposition to safety measures.

Notably, the complaint does not directly accuse Elon Musk of negligence. Instead, it claims that Musk ordered the implementation of appropriate safety measures. However, Kim alleges that Ba deliberately ignored these instructions, opting to launch an unsecured model. According to the complaint, Kim intended to present his findings during the week of September 15, 2025, but Ba summoned him to a meeting and told him they needed to "go their separate ways" without providing a satisfactory reason.
A few months after Kim left xAI, Grok made headlines again when the chatbot was used to flood X — Musk's social media platform, which also falls under the purview of xAI — with non-consensual sexual images. This incident heightened concerns regarding AI safety and content management.
Kim is seeking compensatory and punitive damages, as well as a declaratory judgment affirming that the conduct of xAI and SpaceX was illegal. Kim's commitment to AI safety predates his time at xAI. While working at Scale AI, Kim participated in AI safety initiatives, such as leading a project that produced training data for AI to detect harmful content and comply with governance policies. Last week, the Center for AI Safety, which focuses on AI-related risks, appointed Kim as president.
